SWEETWATER RENTALS — RENTAL AGREEMENT

1. Responsibility, Use & Disclaimer of Warranties. You are responsible for the use of the rented items. You assume all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnify and hold Sweetwater Trading LLC harmless from all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items. YOU AGREE THAT NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED.

2. Equipment Failure. You agree to immediately discontinue the use of rented items should it at any time become unsafe or in a state of disrepair, and will immediately (within one hour) notify Sweetwater Trading LLC. Sweetwater Trading LLC shall not be responsible for injury or damage resulting from failure or defect of rented item.

3. Use of Equipment. Renter agrees that items will only be used at the address listed on contract, and only for the purpose for which they were intended and manufactured. Subleasing or improper use is prohibited. Renter agrees they have read all instruction manuals, operating instructions, and warnings related to rented items.

4. Equipment Responsibility. Renter is responsible for equipment from time of possession to time of return. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, or damaged, renter will assume cost of replacement or repair, including labor costs. Renter shall pay a reasonable cleaning charge for rented items returned dirty.

5. Time of Return. Renter’s right of possession terminates upon the expiration of the rental period. Time is of the essence. Any extension must be agreed upon in writing.

6. Late Returns. If renter does not timely return, the rental rate shall continue until items are returned. After 2 weeks or no communication, item replacement will be charged to the card on file.

7. Payment. Renter shall pay all charges in advance. Renter shall pay all reasonable costs of collections, court, and attorney fees. If rental charges are not paid within 10 days of the due date, Sweetwater Trading LLC may re-calculate charges on a daily basis.

8. Booking Deposit. Renter shall pay a 30% non-refundable booking deposit at time of reservation. Deposit will be forfeited if reservation is canceled within 72 hours of pickup. If no deposit was taken, customer is still responsible for a 25% cancellation fee.

9. Security Deposit. Sweetwater Trading LLC shall place a security deposit hold equal to 20% of the total rental invoice on the credit or debit card provided at booking, processed via Stripe. This hold does not constitute a charge but reduces available credit during the rental period. Upon return and satisfactory inspection, the hold will be released within five (5) business days. If damage, loss, theft, or excessive cleaning is identified, Sweetwater Trading LLC reserves the right to capture all or a portion of the hold. If costs exceed the hold amount, Client expressly authorizes Sweetwater Trading LLC to charge the card on file for the remaining balance. If the card is declined, Client remains personally liable and agrees to remit payment within seven (7) days of written notice. Sweetwater Trading LLC reserves the right to pursue all available legal remedies for unpaid balances.

10. Care & Delivery of Equipment. Renter shall clean and repackage rented items in original packaging. Renter shall protect items from weather damage, breakage, unauthorized use, theft, or loss while in possession.

11. FL Sales Tax. Florida state sales tax of 6.5% (6% state + 0.5% Lee County per F.S. §212.031) applies to all rental charges.

12. Electronic Signature (F.S. §668.50). By checking the box below and completing payment through Stripe, Customer executes a legally valid electronic signature under the Florida Electronic Signature Act. Stripe records IP address, device, timestamp, and payment authorization as a legally admissible audit trail.

13. Governing Law. This Agreement shall be governed by the laws of the State of Florida. Disputes shall be resolved in Lee County, Florida courts.

14. Entire Agreement. By checking below, Customer confirms they are 18 years of age or older, have read and understood this Agreement in its entirety, and agree to all terms herein.
